If you shoot someone and he dies after refusing a blood transfusion, is it murder?
Hey, I've got no sympathy for the Fresno wannabe gang-banger who did the shooting, but it must be noted that this is an odd set of circumstances.
The shooter, obviously, isn't by any means a paradigm of model citizenry and thoughtful decision-making. CEO of a tech firm's definitely not in his future:
Quevedo has already served time in prison for felony battery and theft and was on supervised release when he was arrested for shooting Silva.
Silva, however, was a Jehovah's Witness, and he died in surgery after refusing blood transfusions on religious grounds. Although Quevedo has been charged with murder, it's kind of unique territory: if you shoot somebody and he dies, that's clearly murder. But if you shoot somebody and he dies because he refused transfusion because of his religious beliefs, does that qualify as murder?
